04th Nov 2010:Vital break through achieved: DOT issues orders directing directing it's CCAs to fix the pension in accordance to the earlier order of BSNL on fixation of pay for those having exercised option to continue in the CDA scale till promotion/retirement after absorption in BSNL in accordance to the provisions contained in the terms and conditions of absorption. The order also directs CCAs to refund the recoveries in respect of those who retired after exercising this option. This is a landmark breakthrough and has come after strenuous efforts of more than 4 yrs by this Association. We are extremely grateful to Members(S) Telecom Commission, DDG(Est) DOT and GM(Est.) BSNL for their painstaking effort and positive interpretation of the order of BSNL.
Meeting with Secy. DOT: GS along with both the AGSs met Secy. DOT to greet him on DIWALI and fully seize the opportunity to request him to expedite the process of absorption of ITS as fast as possible since delay in resolution of this issue has resulted in tremendous demoralization and loss of confidence down the level. On the equipment procurement issue Association strongly pleaded for effective and positive intervention of DOT to put in place a sound and viable mechanism for immediate procurement of GSM equipment. Association also pleaded with Secy. DOT to ensure that BSNL is not discriminated against in terms of implementation of telecom policy and licensing conditions as has been happening in the recent past, and specifically mentioned two issues of levying an increased license fess on AGR and Spectrum charges. Association also requested him to uphold the policy commitment of the govt. made from time to time with regard to supporting expansion plan of BSNL in landline, wireless segment in rural and remote areas. Secy. DOT assured that concrete steps are already being taken to address these issues.

BSNLCO has directed to keep the ACRs ready by 31.05.2010. Inspite of repeated reminders from CHQ, our CSs are failed to sent the ACRs even after 5 months thereby delaying the first promotion of JTOs recruited in 1994 and 1995 and completed almost 15 years of service as JTOs. All the CSs are directed to meet the CGMs immediately and camp at Circle office till the ACRs are despatched to BSNLCO by hand. All CSs/CHQ office-bearers should give a day to day report to the GS. |

07th Sept 2010: A very positive breakthrough on the revision of Pension issue:
We understand very reliably that three nodal ministries i.e DOE (department of expenditure), DOP&PW and Ministry of law have sent in their views on the proposal of DOT regarding pension revision. We also understand that their views are generally in line with the proposal of DOT. Views from DPE are expected within a couple of days, after which, note, based on the views of the nodal ministries, shall be sent for consideration of the Union Cabinet.
It is also understood that the inordinately delayed issue of exercise of option to continue in CDA pay scale till the date of promotion/retirement after absorption in BSNL is receiving positive consideration of DOT. |

31st August 2010: Why do we need to participate and make the strike on 7th Sept,10 called by the Central trade unions a total success – what are the issues?
Not having been influenced by political considerations of any kind at any point of time, this Association, having all along maintained apolitical line of thinking, is constrained to jump into the strike called by Central trade unions on 7th Sept, 10 for more reasons than one.
Fundamental reason that we all have to recognize and accept is that this government is hell bent upon destroying the very foundations of CPSUs of which BSNL is an important national institution. The policies of the government of late do not leave anyone in any doubt that the government in order to bridge its huge fiscal deficit is determined to play havoc with CPSUs by offloading its equity in strategic CPSUs, core of Indian economy. Besides, the government is also pursuing policies to destabilize CPSUs to eventually privatize them. In this context, let us have a close and critical analysis of how the policies of the government have brought BSNL to a brink of disaster.
A) Abolition of ADC: The commitment made by the government that BSNL would be adequately compensated through ADC by private operators for making huge investments to develop wide spread country wide telecom infrastructure in the remotest parts of the Country from which it has been getting negligible returns has not been fulfilled by abolishing this regime and giving huge benefits to private operators by allowing them to fully exploit this infrastructure at the cost of incredibly huge investments made by BSNL without any returns.
B) Charging of penal interest on the notional loan given by Govt. to BSNL at the time of Corporatization: Government has imposed and realized penal interest from BSNL on notional loan of about Rs 6000 crores that it gave to BSNL at the time of Corporatization in the year 2000 to start its operations. The interest that government realized from BSNL is quite huge compared to what the banks would have charged from BSNL had it taken capital loan from them.
C) Non payment of USO fund: BSNL is being consistently denied its legitimate share of USO funds. BSNL is highest contributor towards this fund which is now being distributed to private operators by amending the provisions of the Indian telegraph act. Government at the moment has about Rs 20,000 crores from USO fund out of which more than 15,000 crores are contributed by BSNL. This fund basically meant for growth of landline services is being lavishly distributed to the private operators to allow them flourish in mobile segment for which the fund was never meant by amending the Indian telegraph act.
D) Paralyzing the growth of BSNL by scrapping tender for procurement of 45.5 m mobile lines in year 2007: BSNL which was running parallel to Airtel in mobile segment till 2006-07 started crumbling when its crucial tender for procurement of 45.5 m mobile lines was scrapped for no reasons. This was the beginning of losing of its market share due to non availability of equipment in potential Circles for more than three years and it never recovered the ground. Today, it has a market share of about less than 12% in wireless segment due to scrapping of the tender in year 2007. In fact, scrapping of the tender was the beginning of the grave for BSNL. Even today, BSNL has virtually no tender on which it can place orders for procurement of GSM equipment.
E) Exhausting the reserves of BSNL by arbitrarily charging Rs 18,000 crores as 3G and BWA spectrum charges from it in complete violation of the provisions of NTP 1999: Provisions of NTP 1999 which clearly envisage that BSNL pay a nominal spectrum fees for entering 2G/3G/BWA segment were completely violated by forcing BSNL to pay highest bid charges for 3G/BWA spectrum and that too without giving it an opportunity to participate in the bidding process that was open to private operators. While private operators were given unbridled freedom to bid for Circles of their commercial choice, BSNL was strangulated by forcing it to pay Rs 18000 crores for highest pan India bid for 3G/BWA spectrum. This shameful act of government is nothing but to exhaust resources of BSNL to fill its coffers to reduce fiscal deficit regardless of how it impacts the reserves and growth of BSNL.
F) Out rightly rejecting innovative reforms of Pitroda panel relating to equipment procurement and induction of new management structure for revival of BSNL: Not only have radical reforms of Pitroda panel for revival of BSNL been thrown to the dustbin by the government and the bureaucracy, but bureaucracy has finally succeeded in framing and finalizing the eligibility criterion for selection of CMD/BSNL in such a manner that gives a great scope for induction of a bureaucrat, even a retired one, to preside over the destiny of BSNL in such a precarious situation. Government has made a mockery of the efforts of Hon’ble PM to revive BSNL by consigning to flames the innovative reforms of the Pitroda panel constituted by Hon’ble PM that would have considerably helped in turning around BSNL. Bureaucracy is fast digging the grave of BSNL by framing such eligibility conditions for selection of CMD/BSNL.
G) Non resolution of crucial issue of ITS absorption: Non resolution of this vital issue deliberately by the government for the last more than five years has adversely affected the growth of BSNL. Government even today is not at all serious and interested to address this core and fundamental issue of growth of BSNL. On one pretext or the other, the issue is being dragged on for the last five years and today a situation has been created where ITS enjoying everything best of both the Govt. and BSNL has naturally no interest to get absorbed. This situation is created by indecisiveness and lack of will on part of the Government.
H) Serious discrimination met out by DOT to BSNL while implementing telecom policies: While total freedom was given to private operators to procure GSM equipment from Chinese vendors at cheap rates, BSNL was deliberately restrained by DOT to procure equipment from Chinese vendors in the so called name of National security thus badly impacting the procurement process of BSNL and giving huge business advantage to private operators. It is only very recently when this Association strongly condemned this discriminatory attitude of DOT towards BSNL that this blatant discrimination is waived off.
I) Unpardonable discrimination met out to BSNL by DOT in the matter of calculation of AGR and payment of license fees on spectrum: While huge concessions based on the judgments of TDSAT were doled out to one private operator after another by DOT to pay license fees on AGR excluding revenues earned from nine telecom activities and payment of license fess on spectrum at reduced rates, BSNL is even today being forced to pay license fees on higher AGR(inclusive of revenues earned from non telecom activities) and higher license fees on spectrum, thus deliberately depleting its replete resources. DOT has made complete mockery of level playing field.
What else does the government need to do to completely finish the very existence of BSNL. Policies of the government have taken BSNL to a point of complete collapse and disaster. Only the policies of the government, if we carefully analyze, are instrumental in near total destabilization of BSNL. Since the strike call given by Central trade unions in addition to other demands also condemns the policies of the government to destabilize CPSUs/PSUs to eventually privatize them, of which BSNL is a glaring example, SNEA(I) cannot obviously be a mute spectator in not participating in condemnation of the govt. policies to destabilize CPSUs. That is the core issue. We are not at all going into the debate of whether the strike has political connotations or not. What we know that policies of government which have wrecked BSNL need to be vociferously and unequivocally condemned and since the strike call is given by all Central trade unions cutting across party affiliations, there is absolutely no justification in labeling the strike as politically motivated one. That is irrelevant and absurd as far as issues are concerned. Besides, Central trade unions are also raising a very significant demand of introducing a much more improvised and secure pensionary scheme for employees of Central govt., including CPSUs, inducted after 1995.
Thus, Comrades, CHQ of SNEA(I) calls upon each and every Comrade in every nook and corner of the Country to AGGRESSIVELY AND FULLY participate in the strike on 7th Sept, 10 to register their strongest disapproval and condemnation of the policies of the Central government to destabilize CPSUs in general and BSNL in particular. Make the strike a spectacular success to get total and committed support of Central trade unions for our own strike of three days in October, 2010 to address vital issues of revival of BSNL.

BSNL partially restores mobile service in Leh:
<<Hindu News >> Bharat Sanchar Nigam Limited (BSNL) has managed to restore its mobile phone service in some areas here. BSNL chief general manager Mishi Nath Gupta told TheHindu over phone from Jammu that the short message service (SMS) service could not be restored for some time as the machinery was completely damaged in flash floods and it would take time to replace them.
The service was not banned in Leh prior to the floods, he pointed out.Mr. Gupta said the mobile service was restored in an area of two km as they managed to temporarily fix up the machinery in its quarters, the Deputy Commissioner's office and the Army area. Two towers were restored in that area. This was made possible by the airlifting of the machinery by the Air Force. “We are working very hard to restore the services, but since the road is blocked, heavy machinery cannot be taken there so it may take longer time to restore the landline service.” Optical fibre cable was also damaged as roads were washed away in the floods.BSNL has sent 25 more satellite phones to restore communication.
12th August 2010 : FLAS NEWS----CDA - IDA option: In a case filed by our activists at Chennai, Hon CAT, Chennai given a favourable judgement directing DOT to pay the pension on the average of last 10 months pay drawn by BSNL and pay the arrears with 9% interest. Earlier Hon CAT, Ernakulam also given similar judgement on 14.06.2010.

31st July 2010: DPC for promotion of SDE to Adhoc STS completed. Orders are expected for 1031 SDEs. OC -- 781 (upto seniority no. 16746), SC -- 166 (upto seniority no. 17198.277) and ST -- 84 (upto seniority no. 27686).
GS along with both the AGSs met Member (Services)/DOT;
Inputs required by M(S) relating to the issue of exercising of option to continue in CDA scale were submitted to him and very elaborate discussions covering all the aspects of the issue took place. Inputs given to M(S) were comprehensive and enabled us to justify orders issued by BSNL Co convincingly. However, it appears M(S) has an open mind on the issue and is exploring all the possibilities to resolve the issue.
Meeting with Director (HRD):
GS along with both the AGSs had discussions with Director (HRD) in the presence of GM(P) on the following issues.
1) Re allotment of STR people to respective recruiting Circles: Director(HRD) directed GM(P) to expedite issuing of orders to re allot STR people to TN, KTK and AP. GMP) assured that very shortly necessary orders would be issued.
2) One year tenure at Leh and Srinagar: Director(HRD) directed GM(P) to treat Leh as one year tenure for everyone whereas in respect of Srinagar he asked GM(P) to discuss the issue further and find an amicable settlement as quickly as possible. We assure Srinagar Comrades posted from other Circles that the issue will be resolved satisfactorily within a couple of days.
3) Change of designation consequent upon getting time bound scales: Director(HRD) directed GM(P) to conclusively resolve the issue in consultation with the concerned Associations as early as possible. GM(P) assured that the issue would be resolved very soon.

This is in continuation of our earlier agreement to give separate designations on TBP. Assn demanded separate designations for each Time Bound Promotions. Committee appreciated our suggestions. Further discussions will be held next week. Committee will be interacting with other Associations also next week. 30-06-2010: JAC decided for nation wide campaign on the issues related to the Financial viability of BSNL such as 3G and BWA spectrum charges, absorption of ITS officers, Procurement of sufficient GSM lines etc. As part of this JAC decided for post card campaign to Hon. PM by all the comrades by 05th July and Conventions at Major cities. It is decided to conduct National convention at New Delhi in the third week of July and regional conventions at major cities before the National convention at Kolkatta, Chennai, Bangalore, Hyderabad, Pune, Lucknow, Guwahati and Jaipur. MPs and Central trade Union leaders will participate in the conventions.

BSNL rapidly heading towards bankruptcy – reserves as on March, 11 – Minus 12559 crores – this is the definition of bankruptcy of a commercial organization in terms of simple financial language.
Are we aware of this simple statistics and what it really means?
In simple terms it means the Company will have no finances and means to pay for the monthly wages in the days to come.
What is the monthly annual wage bill inclusive of pensionary provisions, leave salary etc for employees of BSNL – 12000 crores approximately.
Who are going to be hit – all absorbed employees of BSNL, except ITS, and their innocent families will shortly start bleeding because of the financial crisis that has engulfed BSNL from all sides.
Does BSNL have any other resources except its fixed assets of land and buildings etc. to meet the huge expenditure on annual wages, let alone future expansion plans – No.
Who is responsible for present deadly crisis - government’s total lack of will and interest to groom BSNL as a viable commercial Company as its 100% equity holder, frequent and uncalled for political and bureaucratic interference in day to day business policies of the Company, a thoroughly inefficient, unprofessional management, devoid of vision and leadership qualities, prone to interference, and fundamentally not owing allegiance to the Company, and trade unions/associations cutting across all considerations and affiliations.
Can the situation be retrieved and who can do that – At this belated stage, when everything is virtually lost, only a brave, spirited and determined fight and movement of the workers can reverse the situation. Trade unions/associations need to understand that it is meaningless to indulge in cat races to decide who is going to be number one, two etc. It has no relevance in the present context where workers and their families will start experiencing worst and unbelievable financial situations very soon. Trade unions/associations will be solely responsible for massacring their workers if they don’t read the writing on the wall.
23rd June 2010:Regular / Adhoc promotion to STS: 1. The status of vigilance clearance from few circles only intimated to CHQ. Status of remaining Circles also should be intimated to CHQ on a day to day basis by CSs / Jt Secs(CHQ).
Intimation of below bench mark entries in the ACR -- So far the report from GUJ(both SDE & Adhoc DE) and KRL(only Adhoc DE) Circles only reached BSNLCO. Report from other Circles are urgently required.
18th June 2010:The case filed by some SDEs to stay ongoing adhoc STS DPC in Hon'ble CAT Banagalore came up for hearing on 18th June 2010 . Hon'ble CAT while declining to stay the ongoing DPC , admitted the case and posted it for 1st JULY 2010.
18th June 2010 : Do or die situation has descended.
DOT has asked BSNL to pay Rs 8313.78 crores as spectrum charges for BWA latest by 22nd June, 2010, in addition to Rs 10,186 crores that it has already paid for 3G spectrum.
Does BSNL really need BWA spectrum to provide internet/ broadband services when it has nearly 70% unutilized copper? Is it worth for a Company reeling under severe financial crisis to invest Rs 8313 crores on a business whose returns as of now are negative?
Private operators having bid for BWA spectrum for select potential circles are not going to use it for providing Wimax services but are to wait for a year or so for new upcoming technology Long term evolution (LTE) to provide 4 G services on BWA spectrum once LTE is marketed in India. Besides, private operators have already formed a strong cartel to ensure that they do not compete with each other in potential circles to protect their business interests and also save on their investments on payment of spectrum charges. They have also closely followed this strategy while auctioning of 3G spectrum. BSNL, on the other hand, has paid Rs 10,186 crores, for Pan India, more than 60% of what other leading operators like Airtel, Vodafone, Reliance etc., have paid without giving it any opportunity to select Circles if its business choice. In the same manner, Govt.., without offering BSNL any choice to decide its select Circles, has asked it to arbitrarily pay Rs 8313 crores on BWA spectrum, more than 70% of what other leading operators like Airtel, Vodafone, Reliance etc have paid for select Circles.
What is the way out?
BSNL should straightaway surrender BWA spectrum even though it has invested little over 1200 crores to procure Wimax equipment which has neither so far nor is in future going to yield any revenues. It is in the best business interests of BSNL to lose 1200 crores rather than squander away Rs 8400 crores by paying on BWA spectrum and completely exhaust the reserves of BSNL.
Will BSNL management do it? No, no, no, not at all. It needs a thoroughly professional and tough management full of conviction, honesty and courage to confront administrative ministry and comprehensively defeat its ulterior motives to land BSNL in bankruptcy. We are not going to land in bankruptcy - we are almost bankrupt with our reserves depleting very fast. In a day or two, CMD/BSNL will hand over on a platter another Rs 8313 crores to DOT as BWA spectrum charges, reducing our reserves from 36,000 crores to just about 10, 000 crores. It needs likes of late Sh.Subhir Raha, Chairman ONGC, who defeated the efforts of bureaucrats and politicians to make ONGC bankrupt. Our management is just nowhere even remotely near him.
Who has to save BSNL from total bankruptcy?
Each and every worker of BSNL totally regardless of which Union/Association he or she belongs to has to rise up in arms and hit back with greatest force to defeat well planned conspiracy to sell BSNL to vested interests. We all irrespective of where we stand have a fundamental responsibility to safeguard our families and protect our beloved bread earner from total disaster. We have nothing to lose. We have virtually lost everything. So, why should we be scared of hitting out at the government with tremendous and unparalleled courage and unwavering conviction? Why should we create a painful and pathetic situation where we tell our Children that we were cowards not to struggle and be able to protect our jobs, Company and their future? Whether we succeed or not is an entirely different matter - let us not helplessly watch losing our bread and butter but give a lasting fight till our last breath that posterity remembers as truly historical. This is our humble appeal to every one whose livelihood and the future of family is dependent exclusively on health of BSNL. All our internal scores we can settle once we primarily emerge successful in protecting our beloved Company from getting sunk to the bottom in the deep waters. Let us first create a situation where we can subsequently settle our internal tussles.

“The very continuance of these officers in the sensitive positions they held while finalising highly controversial first-cum-first-served criteria for allocation raises very fundamental and pertinent issue of the bona fides of the administrative ministry of allowing the investigating agency to reach an impartial and transparent conclusion.
“Besides, absence of even a very preliminary action of not transferring the officers sounds ridiculous and virtually makes a mockery of the efforts of Prime Minister Manmohan Singh to get to the crux of the matter,” SNEA (I) general secretary G.L. Jogi told The Hindu.

16th June 2010: THE HINDU reports - BSNL forced to pay more spectrum charges - “It is a serious issue… while we are being forced to pay despite financial difficulties, private operators are making merry. We are writing to the Telecom Secretary to exempt us also from the hike order or we, as principal stakeholders in the company, will move court seeking relief and refund of the amount so far. If the department cannot take legal action, we certainly can do so,” said Sanchar Nigam Executives Association (India) general secretary G.L. Jogi.

1. Association writes to Hon'ble MOC, Shri A.Raja requesting him to immediately disband committee under the Chairmanship of Member(T), Telecom Commission to decide procurement of GSM equipment that BSNL needs for expansion. Association pleads that BSNL board be given complete freedom to decide commercial and business policies to allow it to compete fierce competition. <<Letter>>
2. Association writes to Secretary DOT, Shri P.J.Thomas demanding to immediately transfer officers involved in implementation of licensing policy of DOT for their discriminatory and highly prejudiced stand to levy exorbitant licence/spectrum charges from BSNL, giving tremendous relaxation to private operators. These officers are already under cloud for being involved in finalising highly controversial criteria of first cum first serve for allocation of 2G spectrum which is being probed by CBI and against which a charge sheet has been filed. Having developed unhloy nexus with private operators, these officers are inflicting huge damage on the business interests of BSNL. .<<Letter>>

JAC unanimously decided to resort immediate trade union action programmes i.e. Massive Demonstration on Monday, 14th June 2010 during Lunch / Closing hours and Mass Dharna for one day on Wednesday, 16th June 2010 at BSNL Corporate Office, all Circle / SSA HQs. 04-06-10:Meeting with Director(HRD) :
GS had extensive discussions regarding expeditious completion of DPCs from JTO to TES GrB , TES GR B to adhoc STS and adhoc STS to regular STS were held with Director(HRD) who assured that all possible steps are being initiated to complete all the DPC’s as early as possible and further mentioned that he is very closely monitoring personally monitoring the progress of these DPC’s.
GS had also elaborate discussion with Director(HRD) regarding new IDA pay scales of JTOs and SDEs, strongly pleading with him that BSNL management needs to relook at the whose issue and seriously consider processing fresh proposal of standard pay scales of E2 and E3 for JTOs and SDEs in view of high quality of JTOs getting inducted in the Organization.
Meeting with GM(P) :
Roster in respect of SC/ST Comrades: GS had a very detailed discussion with GM(P) regarding observing of roster in regard to SC/ST for promotion from JTO to SDE and DE to STS. GS clearly impressed upon GM(P) to maintain total transparency in respect of maintaining roster in accordance to existing provisions.We shall also be very closely monitoring this while DPCs from TES Gr B to adhoc STS and adhoc STS to regular STS commence till they are completed and ensure that stipulated provisions to fill up SC/ST vacancies are fully complied with.
GS also had detailed discussion with GM(P) regarding completing DPCs from TES Gr B to adhoc STS, Adhoc STS to regular ST and JTO to TES Gr B as early as possible.

In land line sector only UP(W) and UP(E) Circle shown positive growth. During 2009-10: 15,15,871 land lines surrendered.
In WLL sector GUJ, UP(E), NE-II, MP, BIHAR, RAJ, UKD Circles met the target. CHTD(-100.16%), HR, HP, KRL, WB, KOL TD recorded negative growth. During 2009-10: 7,11,891 WLL connections provided. MP (2,10,848) Circle provided maximum connections -- Congratulations !
In GSM sector HP, OR, KRL, HR, NE-I, NE-II met the target. During 2009-10: 1,65,93,887 GSM connections provided. UP(E) (20,46,797), TN (12,17,668), BR (12,02,861), RAJ (11,91,791), KTK (11,62,790), KRL (10,78,666) Circles provided maximum connections -- Congratulations !!
In BB sector KTK, HP, MP met the target. During 2009-10: 18,18,510 BB connections provided. KTK(2,45,320), KRL (2,09,837), MH (1,98,161), TN (1,65,821), AP (1,56,450), GUJ(1,23,370), PB (1,00,438) Circles provided maximum connections -- Congratulations !!!
Assn met GM(Estt) and discussed the issues related to JTOs recruited from TTA cadre as departmental outsider. Their past service, leave, salary and TA/DA during training period instead of stipend, EPF etc has to be settled. Earlier we met Member (Services) and DDG(Estt) of DoT in this regard and requested to give suitable clarifications to the queries made by BSNL in the case of TTAs recruited by DoT. DOT has already replied positively to the queries as we requested. Further Assn pursued the case with Estt and EF section of BSNL for issuing suitable directions to the field units. We requested GM(Estt) to issue the instructions immediately as the training for 2008 batch is already started. GM(Estt) assured that instructions will be issued shortly.
Wage Agreement of non-Executive emoployees signed: Director (HRD) on behalf of BSNL and Com V A N Namboodiri on behalf of BSNL Employees signed a much awaited Wage agreement for the revised pay scales of BSNL non-executive employees. SNEA(I)TN circle congratulates all our associates of Joint Forum/Joint action committee and all the non executive employees of BSNL on this great occasion.
CHQ NEWS: Meeting with GM (Pers): GS along with both AGSs met GM(P) on 07.05.10 and discussed:
1) Regular promotion to STS (Telecom): Since ACRs are already collected from the Circles, we requested to complete the DPC at the earliest. GM(P) assured that immediately on the receipt of fresh VC, DPC will be held and promotion orders will be issued for all the posts.
2) JTO(T) to SDE(T) promotion under seniority quota: All India Eligibility list is published. ACRs called for conducting the DPC for the vacancy year 2008-09 and the process will be completed by July. Assn demanded the inclusion of 2009-10 vacancy also so that DPC in JTO to SDE cadre will become current. After detailed discussion it is decided to include the vacancy for the year 2009-10 also. For this ACR for the year 2008-09 also will be called for.
3) Pending request transfers in the cadre of SDE / DE: We requested to consider all the remaining request transfers in SDE / DE cadres. GM(P) assured that remaining cases will be reviewed next week and orders will be issued.
Lunch Hour Hour Demonstrations in front of CGM office , TN Circle, Chennai on 7-05-2010 Friday: There was massive gathering of comrades in the Demonstrations at Chennai. Circle President Com.S.Sundarakrishnan, Circle VP com.Selvakumar , CS Com.R.Asokhan, ACS Com.Gopinathan, ACS Com. Mohideen Pillai addressed the gathering. Demonstrations were conducted through out the state.
As per the decision taken in the CEC the following Trade Union programmes are to be organised at all the SSA Head quarters and CGM TN Circle office, Chennai. To protest against the Vindicative need based / Rotational Transfer orders issued to SDEs/JTOs.

Circle Executive Committee Meeting of SNEA TN circle was conducted on 29-04-2010 Thursday at Hotel Kanchi Chennai. GS Com.G.L.Jogi , Com.H.Muthu CHQ Treasurer, Com. R.Rajan JS(south) and Com.Venkataraman CS Chennai Telephone District addressed the meeting. Com. S.Sundarakrishnan Circle President presided over the meeting. Com.R.Ashokan Circle Secretary presented the CS Report. All the Circle office Bearers , District Secretaries and CEC members participated in the discussions. CEC elaborately discussed the issue of Rotation/Need based transfer of SDEs /JTOs . CEC unanimously decided that the Circle Secretary to take up the cancellation of orders with the administration treating the issue of order as vindictive in nature.

Meeting with Director(HRD): GS along with both AGSs had a very elaborate discussions for over two hours with Director(HR) regarding very complex issues of stalemated DGM and MT recruitment. GM(P), GM(SR) and GM(Rect) were also present. After extensive discussions and exploring various options to expeditiously complete the process of recruitment of DGMs and MTs so as to build a talented and young middle level management in BSNL to take care of future Managerial needs of the company, Director(HR) informed that a committee comprising GM(legal), GM(SR), GM(P) and GM(Rect) is being constituted to go into the issue of exploring the ways to expedite stalemated DGM/MT recruitment which will consult all the concerned Associations/Unions before finally deciding the strategy to be finally adopted to expedite the process. From our side we assured full cooperation for recruitment of DGMs and MTs as quickly as possible to have a highly talented and young middle level management in the company to effectively meet emerging competitive challenges.
On the issue of regularization of existing adhoc STS, we were categorically assured that very soon this issue shall be resolved in view of the latest clarification received from DOT.
LDCE from JTO(T) to SDE(T) to be held on 04.07.2010:
1. As on 21.04.2010, around 7000 candidates registered online against 5000 vacancies. All eligible Executives from 1994 rect year who desires functional promotion are requested to prepare for the LDCE as the number of vacancies available in the seniority quota is very less. The last date of submission of application is 28.04.2010. All CSs, SSA/Branch Secs are requested to ensure that all the eligible candidates are informed about the LDCE.
2. The list of 4980 candidates who had taken print out of their applications till 19.04.10 are available on www.intranet.bsnl.co.in or www.internalexam.bsnl.co.in. The candidates who face any problem on online registration are advised to sent email on recttcell@bsnl.co.in.

Hon'ble MOC was in detail apprised about the deliberate attempts being made to derail the process of absorption of ITS and how inordinate delay has adversely affected the growth of BSNL. After getting elaborate feedback from JAC, Secy/DOT apprised that Cabinet note being sent does not contain any demand of ITSA regarding their absorption, neither prospective date of absorption or any other new demand. The note only explains in detail that the absorption process initiated by DOT twice has not met with considerable success, and, as such, Cabinet is being approached to advise DOT as to how to go about in such a situation and deal with huge number of ITS officers having decided not to get absorbed in BSNL. For this, wider consultations with Ministry of law, DOP, D.O.E etc are needed which is expected to talk another three months. After getting advice from Cabinet, DOT will immediately act on the advice of the Cabinet. Hon'ble MOC is fully committed to get the issue conclusively resolved, and is now informed of all the dimensions of the issue. What is extremely significant is that Hon'ble MOC also directed BSNL Management to take immediate action by way of recruitment of DGMs and MTs so that a parallel middle level Management is available in the event of repatriation of ITS from BSNL. When we pointed out that the eligibility conditions for recruitment of DGMs and MTs are finalized in such a manner so as to derail the process, Hon'ble MOC directed CMD and Director(HR) to discuss and finalize eligibility conditions afresh in consultation with the Associations. However, on ITS absorption, two important issues have surfaced, one is that Hon'ble MOC's committed involvement and non inclusion of demands of ITS in the Cabinet note, and the second one is taking immediate action in the direction of setting up a parallel middle level Management in BSNL.
When the demand of fixation of new IDA scales @ 78.2% was strongly pleaded with Hon'ble MOC, he clearly directed CMD to discuss the issue with executive Associations, failing which he advised us to meet him.

CWC meeting at Manali on 8th & 9th April, 2010--Important decisions:
1. Indefinite strike w.e.f 20.04.10: SNEA(I) to take a leading role in organising the indefinite strike w.e.f 20.04.10 at Circle / SSA and local level under the banner of JAC to settle the entire charter of demands including very crucial issue of immediate completion of ITS absorption.
2. Sam Pitroda Committee recommendations: The recommendations of the committee regarding change of leadership and induction of professionals from outside at the board level were wholeheartedly supported. Recommendations relating to adoption of “Managed capacity” and “Managed Services” models in BSNL require a comprehensive study before expressing our final view. VRS, disinvestment, unbundling of last mile copper and outsourcing have to be opposed tooth and nail. Recommendation of the committee on completion of ITS absorption in a time bound manner to be strongly supported.
3. Revival of BSNL: SNEA(I) should be seen as agents and leaders of change in enforcing and implementing sweeping reforms on each and every front. For successful implementation of reforms and their results, it is absolutely necessary to resolve ITS absorption. Any attempt to introduce innovative reforms on procurement policy, HR front, streamlining the whole organization and giving it an entirely new facelift will be futile if unabsorbed ITS officers are asked to oversee implementation of these reforms. Deciding the basic issue of absorption of ITS in BSNL is going to be the key to successful implementation of any new future road map for revival of BSNL.
4. Regularisation of Adhoc STS: CWC unanimously resolved for immediate regular promotion to 2500 STS posts, regardless of whether or not to include 270 competitive adhoc STS. In the meantime, it was decided to get impleaded in Hon’ble High Court of Ernakulam to oppose fixation of seniority and promotion of 147 SDEs to adhoc STS, besides continuing contesting seniority fixation of 270 adhoc STS in Hon’ble Supreme Court.
5. Amendments to BSNL MS R/Rs: The following amendments are to be made in the BSNL MS R/R: a) The basic spirit of R/Rs should be to have uniformity in all disciplines and the R/R provision for Civil / Elect wing has to be modified accordingly. b) The no. of posts to be filled up in JAG cadre should be in the ratio of 50:50 for direct and promotee streams. c) Since bench mark and selection method for Adhoc and Regular promotion to STS is one and the same, adhoc STS Officers should become regular as soon as vacancy arises in regular STS without any further DPC. The adhoc service also should be counted as regular service for all purposes. d) Future promotions in STS and JAG should be regular and not adhoc. e) Change of designation has to take place along with time bound financial upgradation.
6. Pay scales of JTO, SDE and equivalent cadres: BSNL Board approved the E1A and E2A pay scales for JTO and SDE along with other pay scales and these pay scales are pending at DoT for approval. Association shall pursue the matter with DoT /DPE for early approval.
7. Membership verification: The CWC resolved that SNEA(I) should independently go in for membership verification and the discrepancies pointed out by UF with reference to committee’s report should be addressed prior to starting membership verification.
8. Merger of Executives’ Associations: The issue of merger of Executive Associations was discussed with open & positive frame of mind. The formation of United Forum and the achievements made by UF were highly appreciated by one and all. Taking into account future formidable challenges, it was decided to send very strong signals of unity to the base level for further strengthening of United Forum of BSNL Executives. Association shall strive hard to move in the forward direction, not in the reverse direction, in the days to come, with regard to consolidation of unity of the two Associations since Association has all along been a strong protagonist of school of thought of Unity, CWC clearly opined.
9. Co-option to the Post of Asst. General Secretary: Com. A. R. Manani, CWC member from Maharashtra Circle co-opted to the vacant post of Asst. General Secretary/.
10. Civil / Elect wings should be brought under the administrative control of Circles / SSAs.
Secretary, DoT invites JAC leaders for talks on 01.04.2010 at 1500 hrs, to discuss the issues contained in the notice for indefinite strike.

Bharat Sanchar Nigam Ltd (BSNL) will look to roll out Internet Protocol Television (IPTV) services more aggressively across major cities in the State with most channels on the Sun Network set to join the IPTV bouquet from April.
BSNL`s IPTV services had gone commercial with about 140 channels in October in Chennai, and later in Puducherry and Coimbatore . IPTV, which offers several interactive features such as movie-on-demand, was launched in partnership with MyWay services of the Smart TV Group.

The meeting come to the conclusion that the serious issues like ITS absorption, disinvestment, unbundling, VRS etc may not be able to settle with a one day strike. 17th March 2010:Meeting with GM(Estt), BSNL CO: GS along with AGS met GM(E) to have the latest status on a) pay anomaly of JTOs of 2005 batch, b) approval of pay scales of JTOs and SDEs (E1A and E2A) and c) Training allowance. GM(E) informed that as promised to the Association earlier all the cases are processed by the Estt section.
a) Pay anomaly of JTOs of 2005 batch and those got promotion and joined after 01.01.07. Management Committee Note prepared and the same will be discussed in today's MC meeting.
b) Approval of pay scales of JTOs and SDEs (E1A and E2A): As assured to the Association, BSNL requested DoT to delink the approval of E1A and E2A pay scales from E9A as the pre revised E1A and E2A pay scales are already approved by DPE. Association further pursue the matter with DoT/ DPE.
c) Training allowance: On revision of perks, the training allowance was reduced from 15% to 7.5% which resulted in recovery of huge amount. Association strongly taken up this issue with DIR (HRD), GM (SR) and GM (E) and requested to ensure that there is no recovery on account of revision of Training allowance. Accordingly Management Committee Note prepared and the same will be discussed in today's MC meeting. It is proposed to revise the training allowance from 7.5% to 11% sothat there will be no reduction in the allowance.

Case at Hon. High Court of J&K: On 06.0.2.10, the case listed at Hon High Court and argument took place on the jurisdiction of the court. Advocate for the applicant argued on some rules which permits filing of the case in High Court instead of CAT. After argument Judges directed BSNL to file a reply on the subject. Most probably the case will be again listed in the 3rd week of February.
Association writes to Shri Sam Pitroda who has been assigned the challenging task of defining future road map of BSNL to pull it out of the deep crisis that it is in now and urges upon him to address and sort out the key issue of deciding the leadership of the company to bring it out of the present morbid state. Assn. further pleads with Sam Pitroda that unless the key, fundamental and contentious issue of leadership is addressed and resolved, any other recommendation of the committee to transform the organisation would be rendered infructuous . Induction of charismatic stalwarts from outside to head the organisation and decide his team of board of directors shall be the key to the revival of the company.<<letter>>

Approval of pay scales of JTOs and SDEs: GS along with AGSs met Director (SU I), Shri. Brijesh Mishra and discussed at length the issue of approval of pay scales of E1A and E2A as recommended by BSNL Board. Since the issue is extremely important given the fact that the pay scales of new JTOs and their Time Bound Promotions are directly linked with the finalisation of the scales, we shall be vigorously pursuing the case further with BSNL Management and DoT.

Meeting with GM(Pers): GS along with AGSs met GM(Pers) and discussed
1) Regularization of STS officers – We told GM(P) that Management has to take a final decision on this issue immediately as hundreds of officers are retiring without getting the eligible promotion. We are unable to contain the resentment of our members on this important issue.
2) Adhoc promotion to JAG – BSNL has filed appropriate reply in Jaipur CAT on the lines of the reply it had filed in Allahabad CAT regarding holding of examination for recruitment of DGMs. The case at Jaipur CAT is coming up for hearing on 11th Feb.,10.
However, Comrades start making hectic Country wide Organizational preparations to defeat the sinister moves of the BSNL Management to stall our functional career growth on flimsy and baseless grounds. We thought that good sense will prevail and BSNL Management will act in positive manner to settle three major issues i.e promotion to Adhoc JAG, regularization of about 2500 adoc STS and promotion of about 2500 TES Gr B to adhoc STS. In the name of so called legal stalemate, Management is delaying issuing of orders, thus depriving hundreds and hundreds of our Comrades retiring every month of their promotion to JAG, regularization to STS and Adhoc promotion to STS.
Get ready for a prolonged organizational struggle to secure justice. Struggle which we wanted to avert because of the precarious situation in which BSNL is in at the moment is being forced on us by unreasonable and sinister designs of BSNL management. We stand committed to defeat and expose this discriminatory and prejudiced stand of BSNL management.
Pay anomaly of JTOs of 2005 batch: In continuation to series of earlier discussions and regular correspondence that we have had with Director(HRD) on the important issue of removing the pay anomaly of the JTOs of 2005 year on justified and genuine grounds by extending the benefit of 30% fitment to all the JTOs of 2005 year of recruitment, regardless of their date of joining, GS has clearly brought out that due to this anomaly the difference in basic pay as on 01.1.2007 is Rs 5220/- , and even if the E1A pay scale is approved, the difference in basic pay will be Rs. 2770/- . The losers are further to suffer the ignominy of a recurring two-year lag in their Time Bound Promotions throughout their career also. << Letter>>
In continuation to our several discussions with DIR(HR) and GM(Estt) on this issue, GS along with AGSs met GM(EF), Smt. Aruntadi Panda, and discussed the issue in detail. We pleaded with her to resolve the genuine issue at the earliest and take a positive stand on the issue. Further we discussed and suggested three to four workable proposals by which the issue can be resolved in totality by extending the benefit of 30% fitment to all the JTOs of 2005 year of recruitment.
Issues related to JTOs recruited as Dept outsider from TTA Cadre: In the meeting with GM(EF), Smt. Aruntadi Panda, we discussed this issue further. On the basis of our earlier meetings and discussions with GM(Estt) on the issue, the file has moved to GM(EF). The issues include a) counting of past service as TTA for all the purposes including pension, b) TA/DA and salary during training period, c) accounting earlier E/L & HPL etc. we will pursue the matter further.
GS, along with AGSs met Shri Gopal Das, Dir(HRD), BSNL, on 28th Jan’10 and discussed the following issues. Shri R.K. Mishra, GM(P), was also present in the meeting.
1. Promotion from STS to JAG adhoc in Telecom.
2. Regularization of STS (Adhoc) officers in Telecom.
3. ACP anomaly of Civil/Electrical/Architecture/TFs/CS Executives.
4. Promotion from SDE to STS (Adhoc) in Telecom.

Procurement of redundant Cordect technology a big fraud in the offing in BSNL-Comrades of TN , KTK, HR should maintain high level of preparedness to defeat the evil designs of the officers in BSNL Corporate office to procure highly redundant cor-dect broadband technology from M/s Midas communications a Chennai based firm having strong political links . The equipment has already failed validation at TN five times because it could not comply with technical requirements envisaged in the tender. Procurement of this obsolete equipment shall be a big scandal in BSNL and would lead to heavy losses in TN, KTK and HR circles. Association strongly condemns the continued efforts of BSNL management to force TN circle to validate the equipment on flimsy grounds. GS writes to CMD protesting against the arbitrary procurement of this highly redundant technology. 14th Jan 2010NGN tender: Association strongly condemns complete inaction and indecisiveness on the part of DIR(CFA), BSNL Board in delaying the finalisation of NGN class 5 tender for one million lines to replace the existing redundant switches. The inaction of the concerned Director is inflicting irreparable damage on the growth of BSNL. GS conveys strongest protest on this account to CMD, BSNL and warns BSNL Management of serious consequences if the said tender is not finalised at the earliest. << Letter to CMD>> |
14th Jan 2010Sending Circle Gradation List particulars for the preparation of All India Eligibility of JTOs: The gradation particulars from most of the Circles are not received so far irrespective of repeated reminders from CHQ. All the particulars are readily available with each Circle and they are issuing officiating promotion on the basis of this. However these particulars readily available with the Circles are not reaching BSNL CO even after one and half months. |
Meeting with GM(Estt), BSNL: GS along with AGSs met GM(Estt) and discussed: a) Submission of data sought by DoT in CDA / IDA option: The required information from Circles were not reached the BSNLCO irrespective of repeated reminders. BSNL is not able to reply to the queries from DoT and hence the issue is not getting resolved. Some Circles like AP reported that it already started recovery of lakhs of rupees on retirement as per the direction of DoT Cell. Hence all CSs are once again requested to send the details urgently.
b) Approval of pay scale of JTOs and SDEs – We requested him to delink the case from other scales as agreed by DIR(HR) in an earlier meeting. Since the pay scales are not finalized, the pay of all the new JTOs are not getting fixed and the Time Bound promotion to SDE equivalent grade also not getting settled.
c) Leave, salary, TA/DA and counting of service for the purpose of pension, retaining the same EPF account no etc for the TTAs selected as JTO as Deptl. outsider. All the issues discussed in details and GM(E) assured that all the issues will be settled favourably. |

Approval of
pending IDA pay scales for JTOs, SDEs and equivalent cadres:
GS and AGSs had a detailed
discussion with the concerned officers in DoT on this issue. The
case is linked with the approval E9A pay scale. BSNL Board
approved the pay scales one year back and sent to DoT for
approval. Due to the non finalisation of the pay scales, the pay
of JTOs of 2005 and 2007 year of rect. not getting fixed. They had
given only provisional pay scale of E1. The pay anomaly of JTOs of
2005 batch also pending. The Time Bound Promotion from JTO to SDE
etc also not issued as the pay scales are not approved. We will
pursue the case further with DoT and BSNL.
GS
along with AGSs met CMD, BSNL on GSM tender issue and extended our
fullest support. We told him to take strong stand on this issue to
ensure uninterrupted supply of GSM equipments for the expansion of
GSM network in BSNL and the entire BSNL staff will be solidly
behind him.

BSNL and discussed Membership verification among Executive
Associations, ACP for Civil/Elect etc.

GSM tender issue: Massive

PURCHASE ORDER FOR
93
MILLION GSM LINES.

BSNLBoard
in its meeting on 30.12.2009 decided to put on hold the 93
million GSM tender, the world's largest ever equipment order.
The objections were raised by members from DoT in the board
meeting. In the earlier
45 million tender also vested interest delayed the tender
process and finally the tender had approved only for 22.5
million lines. SNEA(I) and Joint Forum fought against the
vested interest at that time through agitation.
By the delay we lost almost two
precious years and BSNL slipped from the top / second position
to fourth / fifth position today. This time also M/s Nokia
Seimens with the help of vested interests tried to stall the
93 Million tender process through litigation in the Hon. High
court of Hyderabad but finally failed. All court cases on the
tender have gone in favour of BSNL and even an ‘integrity
panel’ set up with the permission of the Central Vigilance
Commission (CVC) has cleared BSNL of any wrongdoing in the
past regarding this tender. On failing on all other fronts,
the vested interests in DoT now want to scrap the tender and
re-tender it or at least halve the tender size by citing
irregularities. Interstingly the DoT members were silent on
the issue so far.
If the
tender is cancelled it will take minimum one to one and half
year to complete the re-tendering process if everything goes
smoothly and the roll out will take another one more year. By
that time the entire market can be captured by the private
operators and BSNL will be out from the scene.
We have to expose the evil
designs of the vested interests who want to promote private
operators on BSNL's cost and make BSNL sick. We should not
allow this to happen.
The dissenting
note of one of the Board member said
“However, it appears that
BSNL’s marketshare in mobile services, which has today come
down to less than 13% from 18% a few years back, may
ultimately stabilise (at) between 6% and 8% with increased
competition in a total market of about 1 billion mobile
phones”. The motives are crystal clear to any keen observer of
the Telecom scenario in the country. He makes his intention
explicitly and unashamedly clear by stating that BSNL should
end up with a market share of 6% and eventually in a couple of
years be totally thrown out of the market.
An urgent
Joint Forum meeting convened today and discussed this serious
development. The JF unanimously decided to launch
organisational actions to seek the intervention of Hon. Prime
Minister of India to "SAVE BSNL". As part of organisational
actions it was decided to implement the following programmes:
1.
Telegram campaign on 02nd to 04th January, 2010
to Dr. Manmohan Singh, Hon.
Prime Minister of India by Circle/SSA/ Branch Secretaries.
Activists also can send the telegram.
2. Mass demonstration at
CHQ/Circle/ SSA level on 05.01.2010.
On 06th
Janauary, Prime Minister Manmohan Singh will meet
Communications Minister A Raja, Finance Minister Pranab
Mukherjee, DoT Secretary PJ Thomas, top Executives from BSNL
including its CMD Kuldeep Goyal, Executives from the Planning
Commission and Knowledge Commission Chairman Sam Pitroda (who
is also a special advisor to the PM) to discuss the plight of
BSNL. |

The case relating to STS
promotion at Hon'ble Jammu High court is listed on 29th December
2009.
It has come to our
knowledge that Hon'ble High court of Allahabad on 24th December
2009 has passed an order and stayed the order of CAT Allahabad
dated 18th December 2009. It inter-alia says " We, therefore,
direct that until further orders, the effect and operation of the
judgment of the Central Administrative Tribunal, Allahabad dated
18th December, 2009 in Ramit Maurya & 6 Ors. Vs. Union of India,
shall remain stayed".
Since most of the Comrades have
received Pay Revision and Fixation on Financial Up-gradation all
the comrades are requested to donate a minimum of Rs.500 to
SNEA to improve the financial position. ALL the Branch
Secretaries are requested to collect the Donations from members as
well as Subscriptions from members update to Dec 2009.
